Prof. Timothy Terrell, Emory University School of Law
This “legal writing” program is unusual:  It is not actually a “writing” program because it does not contend that partners in successful law firms produce defective or inadequate documents.  Instead, the program’s theme is that even the best law firms suffer from a particular inefficiency. While good firms always contain many good writers, virtually none of these people know why they are good writers.  Partners, as a consequence, are regularly unable to effectively communicate their writing skills to those they supervise.  In turn, and too frequently, they respond to document drafts not by requesting another effort by the author, but by rewriting the document themselves.  To make matters worse, whatever feedback a partner does deliver is usually unintelligible to the associate, and thus the same mistakes regularly reappear.
