Greece has adopted a legal framework for the use of AI. Greek Law 4961/2022 on emerging information and communication technologies has introduced rules and obligations for employers when using AI systems affecting in any way decisions relating to employees, with an impact on their working conditions, their selection, etc. Also affected are medium-sized companies and large companies that use AI systems in the context of consumer profiling or for the evaluation of their employees or partners. Said companies must also maintain an electronic Register of the AI systems they use (eRegister), and prepare and adopt a Data Use Code of Conduct.

Which agency regulates the use of AI in your jurisdiction?

As regards Law 4961/2022, sanctions for breach of the rules applicable in the employment sector are imposed by the Labour Inspectorate.

In the context of the AI Act, the Ministry of Digital Governance published the list of national authorities and bodies responsible for enforcing or supervising compliance with EU obligations concerning the protection of citizens’ fundamental rights, including the right to non-discriminatory treatment, when using high-risk AI systems. These authorities/ bodies are: i) the Hellenic Data Protection Authority, ii) the Greek Ombudsman, iii) the Hellenic Authority for Communication Security and Privacy, and iv) the National Commission for Human Rights.
