Which agency regulates the use of AI in your jurisdiction?

At present, there is a draft of domestic law on AI in discussion at the Council of Ministers of Italy. According to this draft, two agencies are identified:

  • The Agenzia per l'Italia Digitale - Agency for Digital Italy ("AgID") with the duty to promote the innovation and development of AI, establish procedures and exercise functions and duties in the area of evaluation, accreditation and monitoring of entities responsible for verifying the compliance of AI systems;
  • The National Cybersecurity Agency ("ACN") ensures the protection of national cybersecurity, responsibility is assigned for the supervision of AI systems (including inspection and sanction activities), as well as responsibility for the promotion and development of AI with respect to cybersecurity profiles.

Both agencies ensure the establishment and ongoing management of regulatory sandboxes in terms of the EU AI Act, in addition to ensuring coordination and collaboration with other PAs and independent Authorities, including through a Coordination Committee established in the Italian Prime Minister's Office.
