Has specific legislation, final regulations or other formal regulatory guidance addressing the use of AI in your jurisdiction been implemented (vs reliance on existing legislation around IP, cyber, data privacy, etc.)? | No. As a member of the European Economic Area ("EEA"), Norway implements most of the directives and regulations from the EU. Norway will likely implement the EU AI Act in due course. Currently, Norway has not implemented any specific legislation, final regulations or other formal regulatory guidance addressing the use of AI, but relies currently on existing regulations around IP, cyber, data privacy, etc. |
Please provide a short summary of the legislation/regulations/guidance and explain how legislators aim to strike the balance between innovation and regulation. | Not applicable. |
Which agency regulates the use of AI in your jurisdiction? | There is currently no single agency regulating AI in Norway. Ultimately it is the Norwegian Parliament who regulates the use of AI as such. To the extent that current legislation and regulations govern the use of AI (e.g. the processing of personal data by or in an AI solution), it is the relevant department of the government given authority by law to regulate further under current legislation by virtue of general regulation or individual decisions. Furthermore, the supervisory authority mandated under a specific law will typically provide guidance in respect of the relevant legislation and regulation. As an example, the Norwegian Data Protection Inspectorate has the authority to supervise and provide guidance under the Norwegian Data Protection Act in respect of the processing of personal data in AI systems. |
