Has specific legislation, final regulations or other formal regulatory guidance addressing the use of AI in your jurisdiction been implemented (vs reliance on existing legislation around IP, cyber, data privacy, etc.)?

No. To date, no local legislation dedicated to AI has been adopted. In this context, we note, however, that in October 2024, the first draft of the local Polish Act on Artificial Intelligence Systems was published.

In September 2024, the Ministry of Digitalization published a public statement on AI-prohibited practices. It contains explanations of each specific prohibited practice together with relevant examples of such practices.

Please provide a short summary of the legislation/regulations/guidance and explain how legislators aim to strike the balance between innovation and regulation.

The draft of the Polish Act on Artificial Intelligence Systems aims to establish a local AI supervisory authority responsible for the supervision of the application of the EU AI Act (AI Development and Security Commission). The draft regulates, inter alia, the structures of the new authority and its supervisory powers. It also includes regulations on incident reporting procedures, notifying authorities and administrative penalties. It also gives the new authority the right to issue interpretations of the EU AI Act.

Which agency regulates the use of AI in your jurisdiction?

To date, no dedicated authority has been designated to oversee and regulate the use of AI. Therefore, the use of AI is regulated and supervised by different authorities depending on the sector or field that the authority oversees/regulates (in other words, supervision is currently dispersed). The draft of the Polish Act on Artificial Intelligence Systems provides that a new AI Development and Security Commission will be established as the main authority responsible for implementing the EU AI Act.
