Please provide a short summary of the legislation/regulations/guidance and explain how legislators aim to strike the balance between innovation and regulation.

The Concept on the Development of Artificial Intelligence in Ukraine, approved by Decree of the Cabinet of Ministers of Ukraine No. 1556-p of 2 December 2020, defines the purpose, principles and tasks of the development of artificial intelligence technologies in Ukraine as one of the priority directions in the field of scientific and technological research. The Concept defines education and vocational training, science, economy, cybersecurity, information security, defense, public administration, legal regulation and ethics, and justice as priority areas in which the tasks of the state policy for the development of artificial intelligence will be implemented.

In addition, in October 2023, the Ministry of Digital Transformation of Ukraine presented a roadmap for the regulation of artificial intelligence in Ukraine. The roadmap includes two stages. In the first stage, which is expected to last 2-3 years (2023-2025), the business community will have the opportunity to prepare for regulation (preparation of general and sectoral recommendations, development of the White Book and other measures). In the second stage, the regulatory process will begin, which will include the implementation of the EU AI Act and the development of a national law, taking into account the experience gained in the first stage.

The implementation of AI regulation is based on a bottom-up approach, moving from non-legislative mechanisms aimed at preparing for future requirements to the adoption of a law. The approach aims to strike a balance between the development of innovation, the interests of key stakeholders and the protection of human rights against risks arising from the development and use of systems using artificial intelligence.

Which agency regulates the use of AI in your jurisdiction?

The Ministry of Digital Transformation of Ukraine (the central executive authority, whose activities are directed and coordinated by the Cabinet of Ministers of Ukraine) participates in ensuring the development of artificial intelligence in accordance with the tasks assigned to it.
