Has specific legislation, final regulations or other formal regulatory guidance addressing the use of AI in your jurisdiction been implemented (vs reliance on existing legislation around IP, cyber, data privacy, etc.)?

No, Saudi Arabia currently does not have specific legislation or final regulations solely for AI. They rely on existing legal frameworks around data privacy ("PDPL") and potentially intellectual property (IP) and cybersecurity for AI development. However, they do have the National Strategy for Data & AI and the AI Ethics Principles, which provide guidance for AI development and use in the country. These principles are not legally binding, but compliance is encouraged to avoid issues with existing regulations. Saudi Arabia's AI Ethics Principles aim to guide responsible AI use without stifling innovation. The Strategy focuses on establishing Saudi Arabia as a leader in the AI field, while the AI Ethics Principles outline seven key principles:

  • Fairness, Privacy & Security: Minimizing bias and ensuring user data protection.
  • Humanity: Prioritizing human rights and values in AI design.
  • Social & Environmental Benefits: Encouraging AI use for positive societal and environmental impact.
  • Reliability & Safety: Ensuring AI systems are dependable and minimize risks.
  • Transparency & Explainability: Providing clear communication about AI decision-making.
  • Accountability & Responsibility: Establishing clear ownership and responsibility for AI development and use.

This approach reflects a desire for innovation balanced with responsible development. They leverage existing data privacy and cybersecurity regulations to mitigate risks without creating entirely new, potentially innovation-chilling, legislation.

Please provide a short summary of the legislation/regulations/guidance and explain how legislators aim to strike the balance between innovation and regulation.
