On February 1, 2024, Alaska became the first state to adopt the National Association of Insurance Commissioners model bulletin governing insurers’ use of AI Systems, now in effect for all licensed insurers in the state.
- The bulletin requires insurers to implement robust governance frameworks, including formal policies, risk management protocols, testing procedures, internal audits, board oversight, and accountability for third-party vendors.
- It mandates that any AI-driven decision affecting consumers must comply with existing federal and state consumer protection laws and must avoid arbitrary, inaccurate, capricious, or unfairly discriminatory outcomes.
- The Alaska Division of Insurance will now include insurers’ AI usage documentation and disclosure as part of market conduct examinations and investigations.
