Has specific legislation, final regulations or other formal regulatory guidance addressing the use of AI in your jurisdiction been implemented (vs reliance on existing legislation around IP, cyber, data privacy, etc.)?

Yes. 

Please provide a short summary of the legislation/regulations/guidance and explain how legislators aim to strike the balance between innovation and regulation.
  • H.B. 1429 (2025): amends N.D. Cent. Code §§ 12.1-17-07 and 12.1-17-07.1, which prohibit harassment and stalking, to include use of a robot.  (“Robot” means an artificial object or system that senses, processes, and acts using technology, including the associated elements, communication links, and artificial intelligence. The term includes remotely piloted aircraft.”)
  • H.B. 1386 (2025): amends N.D. Cent. Code §§ 12.1-27.2-01 and 12.1-27.2-04.1, which prohibit possession of child pornography, to include images generated by AI.
  • H.B. 1167 (2025): requires any action taken for a political purpose that involves using artificial intelligence to visually or audibly impersonate a human to contain a disclaimer stating: “THIS CONTENT GENERATED BY ARTIFICIAL INTELLIGENCE.” The act does not apply to AI used solely for text generation, editing, or revisions without creating a new impersonation of human likeness or voice.
