Yes. 

Please provide a short summary of the legislation/regulations/guidance and explain how legislators aim to strike the balance between innovation and regulation.
  • House Bill 101
    • Filed: January 2, 2025.
      • Status: January 8, 2024 – Referred to the House of Representatives Judiciary Committee.  
  • Purpose: 
    • Amend the “Electoral Code of Puerto Rico of 2020”; for the purpose of establishing as a voter right, to inform the voter whether any propaganda, advertisement or communication was generated partially or completely through the use or by means of AI; 
    • Provide a definition of AI.
  • Key Aspects: 
    • Punish with imprisonment for a term not to exceed one year, or a fine of five hundred dollars ($500.00) for each false data, information or image, or both penalties at the discretion of the court, to any person who for the second time, or more occasions, transmits by any means information, data, documents, forms and/or false images created or altered with AI systems in any system operated by the Electoral Commission without providing a legible disclaimer.
    • The use of AI disclaimer shall be using a font size large enough to be clearly read by the person receiving the communications be printed in a contrasting color that distinguishes it from the background and the rest of the communication.
    • If communication is to be transmitted by radio, the message must include in the audio, the statement that an AI system was used for the creation of the communication. 
  • Joint Resolution of the Senate No. 1
    • Filed: January 2, 2025.
    • Purpose:
      • Order the Puerto Rico Innovation and Technology Service (“PRITS”) to create a registry of all companies and businesses operating, developing, or using AI systems in Puerto Rico. 
  • Key Aspects:  
    • PRITS shall establish a paper and digital form in coordination with all agencies and instrumentalities of the Government of Puerto Rico that have contact or relationships with companies or businesses that operate, develop or use AI systems in Puerto Rico. 
    • The Department of State, as well as various instrumentalities of the Government, shall assist PRITS in the registration of such companies. 
    • Beginning July 1, 2025, PRITS shall submit an annual report to the Legislative Assembly, which shall include: 
      • The number of registered companies or businesses utilizing AI. 
      • The number of registrations received by each agency or instrumentality of the Government. 
      • Expenses incurred, if any by the Department of State. 
      • Copies of any documentation used as a source of information. 
      • Copies of any other documentation used as a source of information. 
      • Any other documentation related to the compilation of the registry. 
  • Joint Resolution of the Senate No. 16
    • Filed: January 14, 2025.
    • Purpose:
      • Order PRITS to develop and implement an application based on AI for keeping track of public auction processes in Puerto Rico, guarantee transparency, fairness and prevention of dishonest practices in public auctions. 
  • Key Aspects:  
    • The application shall provide the following features:
      • Real-time monitoring of auction processes. 
      • Analysis of data to identify suspicious patterns or irregular activities. 
      • Generation of automatic alerts in the event of possible irregularities. 
      • Accessible reports for system administrators and auditing entities. 
    • PRITS shall submit a detailed plan for the development and implementation of the application to the Legislative Assembly within ninety (90) days following the approval of the Joint Resolution. This plan shall include: 
      • Work schedule. 
      • Necessary resources for its implementation. 
      • Strategies for the integration of the system with the existing platforms of public auctions. 
                    
  • Senate Bill 68 - “AI Act of the Government of Puerto Rico”
    • Filed in the Puerto Rico Senate on January 2, 2025 
      o    Referred to the Science, Technology and AI Committee 
  • Purpose:
    • Create the Artificial Intelligence Officer of Puerto Rico 
    • Create the Artificial Intelligence Advisory Board of Puerto Rico 
    • Order PRITS to enact AI public policies 
    • Require governmental agencies to report the automated systems used.
