NIS2 Implementation in the EU
Enacted
The NIS2 Directive has been transposed into Belgian law by the Act of 26 April 2024 ("NIS2 Act") establishing a framework for the cybersecurity of networks and information systems of general interest for public security.
- Closely modeled on the NIS2 Directive.
- The list of sectors and/or subsectors falling within the scope of the NIS2 Act may be extended by Royal Decree.
- In addition, other elements may be further specified. In this respect, the Royal Decree of 9 June 2024, implementing the NIS2 Act, completes the transposition of the NIS2 Directive. Inter alia, the Royal Decree designates the Centre for Cybersecurity Belgium as the national cybersecurity authority, sets out the procedures for regular conformity assessments and defines the applicable reference frameworks (e.g. ISO/IEC 27001).
The NIS2 Act has been in force since 18 October 2024.
