Has specific legislation, final regulations or other formal regulatory guidance addressing the use of AI in your jurisdiction been implemented (vs reliance on existing legislation around IP, cyber, data privacy, etc.)?

No.

Please provide a short summary of the legislation/regulations/guidance and explain how legislators aim to strike the balance between innovation and regulation.

Not applicable. However, the Jersey Financial Services Commission ("JFSC"), Jersey's anti-financial crime supervisor, aims to consult on and issue enhanced guidance for FI/DNFBP/VASP entities regarding the adoption and use of AI and risk mitigants. While not on a statutory basis, the guidance expected in mid-2026 will serve to crystallise expectations regarding the use of AI tools in processes within regulated firms and lay the foundation for potential future binding rules. The JFSC is publicly committed to balancing innovation and effective supervision and has stated that it considers industry's expertise to be at least equivalent to its own expertise and will therefore be taking a collaborative approach.

Which agency regulates the use of AI in your jurisdiction?

While there is no formal AI regulator, the JFSC, professional body supervisors, and the Jersey Office of the Information Commissioner have set expectations on the ethical and appropriate use of AI, particularly with regard to video and image generation, and disclosure to clients where AI is used to generate deliverables.
