Has specific legislation, final regulations or other formal regulatory guidance addressing the use of AI in your jurisdiction been implemented (vs reliance on existing legislation around IP, cyber, data privacy, etc.)?

No. No specific legislation in addition to EU rules. The Swedish government is working on various initiatives with respect to AI. The government has, inter alia, published an updated national AI strategy and given different authorities the task of investigating specific questions connected to AI. For example, see question 2 below. A legislative matter is in progress to adapt Swedish law to the EU AI Act.

Please provide a short summary of the legislation/regulations/guidance and explain how legislators aim to strike the balance between innovation and regulation.

For the public sector, the Swedish Agency for Digital Government (“DIGG”) and the Swedish Authority for Privacy Protection (“IMY”) have issued joint guidelines on the responsible use of generative AI by central government, regions and municipalities, intended to foster legal certainty, security and operational efficiency. These guidelines are intended to be continuously updated.

Separately, the IMY has published and periodically updates its “GDPR and AI” guidance, designed to ensure that AI development and deployment remain consistent with EU data-protection requirements.

In its national AI strategy, the legislator emphasizes that Sweden should work to ensure that AI regulation at EU level does not stifle innovation and that existing regulations are reformed to contribute to growth. The DIGG and the Swedish Post and Telecom Authority (“PTS”) are responsible for facilitating the AI strategy and Sweden’s Innovation Agency Vinnova has ongoing initiatives to accelerate the development and use of AI. 

Which agency regulates the use of AI in your jurisdiction?

No agency has the sole responsibility to regulate AI. In an official inquiry from the government, the PTS is, however, proposed to be the main market surveillance authority. In specific areas, sector-specific authorities are proposed to exercise market surveillance in their respective domains, for example the Financial Supervisory Authority for the use of AI in the financial market, IMY for the use of AI in law enforcement, and the Swedish Medical Products Agency for the use of AI in medical devices.
