Has specific legislation, final regulations or other formal regulatory guidance addressing the use of AI in your jurisdiction been implemented (vs reliance on existing legislation around IP, cyber, data privacy, etc.)?

Yes.

  • A draft Law on Artificial Intelligence was submitted to the Presidency of the Grand National Assembly on 24 June 2024. 
  • A draft Law on Amendments to Certain Laws, aiming to establish certain regulations regarding artificial intelligence systems, was submitted to the Presidency of the Grand National Assembly on 7 November 2025. 
Please provide a short summary of the legislation/regulations/guidance and explain how legislators aim to strike the balance between innovation and regulation.

Presidential Circular No. 2021/18 regarding the "National Artificial Intelligence Strategy 2021-2025", prepared in cooperation with the Presidential Digital Transformation Office and the Ministry of Industry and Technology and with the active participation of all relevant stakeholders, was published in the Official Gazette No. 31574 dated 20/08/2021. The strategy reveals the measures that will put our country's work in the field of artificial intelligence on common ground between 2021 and 2025, and the governance mechanism that will be established to implement these measures. As of the date hereof, the National Artificial Intelligence Strategy 2021-2025 has not been renewed for the period of 2026 and onwards. 

Further, the Ministry of Industry and Technology has commenced preparations for an "Artificial Intelligence Action Plan", which is being developed as part of the "National Technology Initiative". Stakeholder feedback is currently being solicited for the Artificial Intelligence Action Plan.

The draft Law on Artificial Intelligence comprises a rather general and non-comprehensive text stipulating principles for developing artificial intelligence, risk management and evaluation, compliance and audit and violations and sanctions. Any further developments or announcements on this matter have not yet been made.

The draft Law on Amendments to Certain Laws, proposes amendments to several existing Turkish laws, including the Turkish Penal Code (No. 5237), the Internet Regulation Law (No. 5651), the Personal Data Protection Law (No. 6698), the Electronic Communications Law (No. 5809), and the Cybersecurity Law (No. 7545), in order to establish a comprehensive legal framework for artificial intelligence. Key measures include criminal liability for AI-assisted offences, mandatory takedown of harmful AI-generated content, compulsory labelling of deepfake material, and oversight powers for the Information and Communication Technologies Authority ("BTK"), with fines for non-compliance.
